Terms of Service

1. Agreement
These Terms of Service ("Terms") govern your use of Piclo AI (the "App"), an aesthetic photo creator operated by Om Tripathi ("we", "us"), an individual based in India. By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Piclo AI. If you are under the age of majority, you may only use the App with the involvement of a parent or legal guardian.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. User Content
You retain ownership of the photos and content you upload ("User Content"). By uploading User Content, you grant us a limited, worldwide, royalty-free license to host, process, and display it solely to operate and improve the App and deliver the outputs you request. You represent that you have all necessary rights to the User Content you upload and that it does not violate any law or third-party rights.
5. Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, hateful, sexual involving minors, or that infringes others' rights.
- Use the App to create deepfakes or impersonations without clear consent.
- Reverse engineer, scrape, or abuse the App or its infrastructure.
- Use the App to harass, defraud, or harm any person.
We may remove content or suspend accounts that violate these Terms.
6. AI Outputs
Piclo AI generates images using AI models. Outputs may be imperfect or unexpected, and similar outputs may be generated for other users. You are responsible for how you use outputs, including compliance with applicable laws and third-party rights.
7. Payments
Paid features, if offered, are billed through third-party payment processors. All fees are non-refundable except where required by law.
8. Intellectual Property
The App, including its software, design, and branding, is owned by Om Tripathi and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, or create derivative works of the App.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App.
10. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or meet your requirements.
11. Limitation of Liability
To the maximum extent permitted by law, Om Tripathi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App. Our total liability for any claim relating to the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
12. Indemnity
You agree to indemnify and hold harmless Om Tripathi from any claims arising out of your use of the App, your User Content, or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
14. Changes to the Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
